Jay H. Bernstein manages the Workers' Compensation practice of Kirsch, Gelband & Stone, in Newark, NJ, specializing in Emergency Motions for Medical Treatment & Surgery, with hundreds of successful court orders for emergency surgery & medical treatment. His practice also includes Social Security Disability law and appellate practice (pro bono Constitutional law for the N.J. Public Defender).
Mr. Bernstein, who has practiced for nearly 25 years, has represented thousands of injured workers throughout New Jersey, and has been named by the Supreme Court of New Jersey as a Certified Workers' Compensation attorney, a distinction held by less than 5% of attorneys throughout the State. Mr. Bernstein has taught and lectured on NJ Worker's Compensation, Federal Social Security Laws and Medicare before the National Business Institute, and authored a treatise on Social Security Disability Law.
Mr. Bernstein served as a legal clerk for the Ministry of Justice, State of Israel, in Jerusalem; a legal intern for the U.S. Congress; and as a Legal Aid Attorney, representing homeless children and families in Trenton. Mr. Bernstein received a Commendation for Superior Performance from the Trial Defense Service of the United States Army, JAG Corps, and a commendation for Volunteer Service in the First Gulf War from the State of Israel.
Mr. Bernstein is an original founding member of the NJ Bar Association, "Mass Disaster Legal Response Program," which has served families of the 9/11 Terror attack, Haitian Immigrants, and Hurricane Sandy victims, giving free legal aid and services, and has been commended by Governor Whiteman, Governor McGreevey and Governor Christie for his services.
Mr. Bernstein is licensed to practice law in New Jersey, Connecticut, Pennsylvania, and Washington D.C.
Mr. Bernstein is an avid legal writer, having been published in numerous legal publications and newspapers, including the Star Ledger and New Jersey Law Journal and Rutgers Law Record. He also testified before the New Jersey Senate Labor Committee Meeting on reforming Workers' Compensation laws to increase benefits for injured workers.
Mr. Bernstein was honored by the Chief Justice of the NJ Supreme Court, the Hon. D.T. Poritz, for service to "9/11" victims and families.
Mr. Bernstein received the President's "Volunteer Service Award" in 2012 for mentoring and teaching Newark School children, and a commendation from the White House.
